Defense Association of New York
 

DANY brings together by association, communication, and organization
attorneys and qualified non attorneys in the state of New York who
devote substantial professional time to the handling of litigated cases
primarily for the defense.

DANY is committed to improving the services of the legal profession,
elevating the standard of trial practice, supporting and working for
the improvement of the adversarial system of jurisprudence in our
courts, and facilitating and expediting trial of disputed claims.

  • DANY congratulates Past President Thomas J. Maroney for being selected to receive the DRI Outstanding State Representative Award for 2011. This is the first time DRI has selected a State Representative from New York.  Well done Tom.
  • The Defense Association of New York Scholarship (“DANY Scholarship”) has been established and funded for the purpose of awarding scholarships to law students and/or legal education programs selected by DANY Board of Directors to award law students who and legal education programs that share DANY’S objective of a well educated bar possessing the finest qualities and character. Applications are currently being accepted.  Click here for eligibility requirements and conditions

A Winter edition of the Defendant is expected December 2011, the deadline for articles is October 15, 2011.  We encourage all members to submit articles for publication on or by the October 15th deadline.

DANY's Committee On The Development Of The Law has filed amicus curiae brief.

Ortiz v. Varsity Holdings, LLC, 75 A.D.3d 538, 906 N.Y.S.2d 766 (2d Dep't 2010).  This case involves the issue of whether a fall from a six-foot high ground-level dumpster is covered by the absolute liability provisions of New York Labor Law §240(1).  DANY's Committee on the Development of the law has submitted a brief in support of the defendant's position contending that such an accident is not within the purview of the statute.  By order dated September 16, 2010, the New York Court of Appeals accepted DANY's amicus curiae brief as filed. It is anticipated that the Court will render a decision on this case in either the Fall or Winter of 2011.
